Privacy Policy

This Privacy Policy explains how Comiker (“Comiker,” “we,” “us,” or “our”) collects, uses,
shares, and protects information when you use our website and AI comic-generation service
(the “Service”). It applies to visitors, registered users, and subscribers worldwide, and is
written to meet the requirements of the EU/UK General Data Protection Regulation (GDPR) and
the California Consumer Privacy Act as amended by the CPRA (CCPA), as well as other applicable
data protection laws.
By creating an account or otherwise using the Service, you acknowledge that you have read and understood this Policy. If you do not agree with it, please do not use the Service.
Who We Are
Comiker is an AI-powered platform that turns a written idea into an illustrated comic - generating story text, character art, and finished comic pages. This Policy covers data processed through comiker.com and any related subdomains or applications (collectively, the “Service”).
For any privacy question, request, or concern, you can reach our team at the contact details in Section 14.
Scope of This Policy
This Policy applies to:
- Anyone who visits comiker.com, even without creating an account
- Anyone who registers for an account, by email/password or by signing in with Google
- Anyone who subscribes to a paid plan through our payment processor, Lemon Squeezy
- Anyone who uploads content (story ideas, character details, or reference photos) to generate a comic
This Policy does not apply to third-party websites, applications, or services that we link to but do not control, including the underlying AI providers, payment processor, and email provider described in Section 5 - each of those providers has its own privacy practices.
Information We Collect
We collect the categories of information described in the table below. We collect this information directly from you, automatically as you use the Service, and from the third-party services listed in Section 5.

Reference Photos and Likeness Data
If you choose to use our “character from image” feature, you may upload a photograph of a real person (which may be yourself or someone who has given you permission). This feature is entirely optional - you can generate comics without ever uploading a photo, using typed character descriptions instead.
When you upload a reference photo:
- The photo is sent to our AI image-analysis provider (fal.ai) solely for the purpose of generating a consistent illustrated character.
- We do not perform facial recognition for identification purposes, and we do not attempt to match the photo against any other database.
- We do not use uploaded reference photos to train any AI model, ours or any third party's, and we instruct our AI providers not to do so on our behalf.
- We do not store an uploaded reference photo, you can delete its associated comic at any time from your comic library; see Section 9.
Reference photos may constitute biometric or special-category data under certain laws (including Illinois' BIPA and the GDPR's Article 9). By uploading a photo of yourself, you provide explicit consent to its processing as described above. Do not upload a photo of another identifiable person unless you have their clear permission to do so.
Information We Do Not Collect
We do not knowingly collect government identification numbers, precise geolocation, health information, or financial account numbers (beyond the limited, tokenized billing data described in Section 3 and Section 5). We do not sell your personal information to data brokers.
How We Use Your Information
We use the information described above for the following purposes:
- To provide the Service: create your account, authenticate you, generate your comics, store and display your comic library, and process the credits associated with your plan
- To process payments: manage your subscription, charge your chosen payment method via Lemon Squeezy, issue receipts, and handle refunds
- To communicate with you: send account verification emails, respond to support requests, and send service-related notices (such as a failed payment or a completed generation)
- To maintain and improve the Service: diagnose technical issues, monitor system performance, and understand feature usage in aggregate
- To protect the Service: detect and prevent fraud, abuse, unauthorized access, and violations of our Terms of Service
- To comply with the law: meet tax, accounting, and other legal obligations
We do not use your story content or reference photos for advertising, and we do not sell your personal information.
Third-Party Service Providers
To operate Comiker, we share information with the service providers below, each acting as a data processor on our behalf and under contractual confidentiality and data-protection obligations. We do not permit these providers to use your information for their own independent purposes.

These providers may process data in the United States or other countries outside your country of residence. Where required, we rely on appropriate safeguards for such transfers, including Standard Contractual Clauses, as described in Section 10.
Legal Bases for Processing (EEA, UK, and Similar Jurisdictions)
If you are located in the European Economic Area, the United Kingdom, or another jurisdiction that requires a legal basis for processing personal data, we rely on the following bases:
- Contractual necessity — to create your account, generate comics you request, and provide the subscription you have purchased
- Consent — for optional features such as uploading a reference photo, and for any non-essential cookies (see Section 8)
- Legitimate interests — to secure the Service against fraud and abuse, to maintain and improve our product, and for basic analytics, balanced against your rights and interests
- Legal obligation — to comply with tax, accounting, and other applicable laws
Where we rely on consent (for example, for your reference photo), you may withdraw that consent at any time, with effect from the time of withdrawal, by deleting the relevant comic or contacting us using the details in Section 14.
How We Share Information
Beyond the service providers in Section 5, we may share information in the following limited circumstances:
- Business transfers — if Comiker is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any material change in ownership or use of your personal information.
- Legal requirements — if required to do so by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud or security issues.
- With your direction — if you explicitly direct us to share information, for example by making a comic public via a shareable link.
We do not share your personal information with third parties for their own marketing purposes, and we do not sell personal information as defined under the CCPA.
Cookies and Similar Technologies
We use cookies and similar technologies for the following purposes:
- Essential cookies — required to keep you logged in, maintain your session, and remember security tokens. These cannot be disabled without breaking core functionality.
- Functional cookies — used to remember preferences such as your selected art style or interface settings.
- Analytics — used in aggregate to understand which features are used and to identify and fix technical issues.
We do not currently use third-party advertising cookies or cross-site behavioral tracking. Most browsers let you control or disable cookies through their settings; doing so may affect your ability to use certain features of the Service.
Your Privacy Rights
Your rights may depend on where you live. We provide the rights and processes described below subject to applicable law.
Rights for Users in the EEA, UK, and Similar Jurisdictions
Subject to applicable law, you have the right to:
- Access the personal information we hold about you
- Correct inaccurate or incomplete information
- Erase your personal information (“right to be forgotten”), subject to certain legal exceptions
- Restrict or object to certain processing, including processing based on legitimate interests
- Receive a copy of your data in a portable, machine-readable format
- Withdraw consent at any time where processing is based on consent
- Lodge a complaint with your local data protection authority
Rights for California Residents (CCPA/CPRA)
If you are a California resident, you have the right to:
- Know what personal information we have collected, used, disclosed, and (where applicable) sold about you
- Delete personal information we have collected from you, subject to certain exceptions
- Correct inaccurate personal information
- Opt out of the sale or sharing of personal information — we do not sell or share personal information as those terms are defined under the CCPA, so no opt-out is necessary
- Limit the use of sensitive personal information — we do not use uploaded reference photos for any purpose beyond generating your requested comic
- Non-discrimination for exercising any of these rights
How to Exercise Your Rights
You can exercise most of these rights directly within your account:
- Delete a comic: open the comic in your library and choose Delete.
- Update account information: edit your name, email, or password from your Account settings.
- Cancel your subscription or remove a payment method: visit the Billing tab in your Account settings, which links to our payment processor's secure customer portal.
- Request full account deletion or a copy of your data: contact us using the details in Section 14. We will verify your identity and respond within the timeframe required by applicable law (generally 30 days for GDPR requests and 45 days for CCPA requests).
We will not charge you a fee for making a request unless permitted by law, and we will not discriminate against you for exercising any of these rights.
International Data Transfers
Comiker and the service providers listed in Section 5 may process and store your information in the United States and other countries that may have data protection laws different from those in your jurisdiction.
Where we transfer personal information from the EEA, UK, or Switzerland to a country that has not been deemed to provide an adequate level of protection, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or another legally recognized transfer mechanism, as incorporated into our agreements with those providers.
Data Retention
We retain personal information for as long as necessary to provide the Service and for the following periods:
- Account data: retained for as long as your account remains active, and for a limited period afterward to allow reactivation and to comply with legal obligations
- Generated comics and reference photos: retained in your library until you delete them or close your account, after which they are deleted from our active storage within a commercially reasonable period
- Billing records: retained for the period required by applicable tax and accounting law, typically up to 7 years, even after account closure
- Support communications: retained for as long as needed to resolve your inquiry and for a reasonable period afterward for quality and training purposes
When information is no longer needed for these purposes, we securely delete or anonymize it.
Children's Privacy
Comiker is intended for general audiences, and many of our comics are designed to be family-friendly. However, creating an account and using AI-generation features requires a certain level of independent judgment, particularly regarding the content of generated comics and the handling of payment information.
- Comiker is not directed at children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent.
- Users between the ages of 13 and the age of majority in their jurisdiction may use the Service only with the consent and active involvement of a parent or legal guardian, who is responsible for reviewing this Policy, supervising the minor's account, and managing any subscription or payment method associated with it.
- A parent or legal guardian who believes their child has provided personal information without appropriate consent may contact us using the details in Section 14 to request that we delete that information.
If we become aware that we have collected personal information from a child without the consent required by applicable law (including the U.S. Children's Online Privacy Protection Act, COPPA), we will take steps to delete that information promptly.
Data Security
We implement technical and organizational measures designed to protect your information, including:
- Encryption of data in transit using HTTPS/TLS
- Password hashing using industry-standard algorithms — we never store your password in plain text
- Access controls limiting which personnel and systems can access personal information, on a need-to-know basis
- Reliance on reputable infrastructure providers (including Amazon Web Services) that maintain their own independent security certifications
No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and any applicable regulator as required by law.

Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, the Service, or legal requirements. If we make material changes, we will provide notice by posting the updated Policy on this page with a new effective date, and, where required by law, by additional notice such as an email to registered users.
We encourage you to review this Policy periodically. Your continued use of the Service after a revised Policy takes effect constitutes your acceptance of the changes.
