Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you and Comiker ("Comiker," "we," "us," or "our") governing your access to and use of comiker.com and our AI comic-generation service (the "Service").

PLEASE READ THESE TERMS CAREFULLY. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. These Terms should be read together with our Privacy Policy and Refund Policy, each of which is incorporated into these Terms by reference.

Eligibility and Accounts

1.1 Who Can Use Comiker

Comiker is intended for general audiences. To create an account, you must be able to form a binding contract under the laws of your jurisdiction.

  • If you are under the age of 13, you may not create an account.
  • If you are between 13 and the age of legal majority in your jurisdiction, you may use the Service only with the involvement, consent, and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any subscription, payment method, or content associated with the account.
  • By creating an account, you represent that all information you provide is accurate and that you meet these eligibility requirements.
1.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at the contact details in Section 16 if you suspect unauthorized access to your account.

You may register using an email and password, or by signing in with a Google account. If you use Google Sign-In, you authorize us to access the basic profile information necessary to create and authenticate your account, as described in our Privacy Policy.

Description of the Service

Comiker allows you to generate illustrated comics from a written idea or story prompt. The Service uses third-party artificial intelligence providers, including OpenAI for story and text generation and fal.ai for image generation, to produce panels, covers, and backgrounds based on your input.

You may optionally upload a reference photograph to guide a character's visual appearance; see Section 5.4 and our Privacy Policy for details on how reference photos are processed.

The Service is provided on a credit and subscription basis as described in Section 4. Features, available art styles, page limits, and credit costs may vary by plan and may change over time as described in Section 4.5.

The Nature of AI-Generated Content

You understand and agree that:

  • Comiker uses generative artificial intelligence, which is inherently variable and unpredictable. The same prompt may produce different results each time, and we do not guarantee any particular outcome, style, accuracy, or quality.
  • AI-generated images and text may contain unexpected artifacts, inconsistencies between panels, or inaccuracies, including in how a character's appearance is rendered from a reference photo.
  • We do not independently fact-check or review the substance of AI-generated story content for accuracy, and AI-generated text should not be relied upon as factual, professional, or expert content of any kind.
  • Despite our content filtering and the restrictions in Section 6, AI systems can occasionally produce unexpected or undesired output. If you encounter generated content that violates Section 6 of these Terms, please report it using the contact details in Section 16 so we can investigate and improve our safeguards.

Subscriptions, Credits, and Billing

4.1 Plans and Credits

Comiker operates on a credit-based system. Each comic generation, and certain regeneration actions (such as regenerating a cover or background), consumes a number of credits determined by the complexity of the request. Your plan determines your monthly credit allowance, the art styles available to you, and applicable hard limits on comics, image references, and premium-style generations per billing period.

4.2 Payment Processing

Paid subscriptions are billed and processed by our third-party payment processor, Lemon Squeezy. By subscribing to a paid plan, you agree to Lemon Squeezy's terms of service in addition to these Terms. We do not store your full payment card details; Lemon Squeezy handles that information directly.

4.3 Automatic Renewal

Paid subscriptions renew automatically at the end of each billing period (monthly, unless otherwise stated) until you cancel. Your payment method will be charged automatically at the start of each renewal period. You may cancel at any time through the Billing section of your Account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.

4.4 Refunds

All payments are governed by our separate Refund Policy, which is incorporated into these Terms by reference. In summary: subscription charges and used credits are non-refundable, except that credits are automatically returned to your account if a generation fails due to a technical error on our side.

4.5 Changes to Pricing and Plans

We may change our pricing, credit costs, plan features, or hard limits at any time. If we make a material change that affects your current paid plan, we will provide reasonable advance notice. Changes will not retroactively apply to a billing period you have already paid for.

Ownership and Licensing of Content

5.1 Your Input

You retain ownership of the story ideas, prompts, character descriptions, and any reference photographs you submit to the Service ("Your Input"). By submitting Your Input, you grant Comiker a worldwide, non-exclusive, royalty-free license to use, reproduce, and process Your Input solely for the purpose of operating and improving the Service, including transmitting it to the third-party AI providers described in Section 2.

5.2 Generated Comics

Subject to your compliance with these Terms and the table below, you receive rights to the comics, images, and text generated for you through the Service ("Generated Content"):

We grant you these rights as a license, not a sale of intellectual property. We retain the underlying right to operate, store, and (where you have made a comic public) display Generated Content within the Service.

5.3 Conditions on Commercial Use

Where these Terms permit commercial use of Generated Content (on paid plans), that permission does not extend to:

  • Any comic generated using a reference photo of a real, identifiable person, unless you have that person's explicit written consent to commercial use of their likeness
  • Any comic that otherwise violates Section 6 (Acceptable Use), regardless of your plan tier
  • Claiming that a comic was created entirely by you without AI assistance, where such a claim would be misleading in the context it is used
5.4 Reference Photos

If you upload a reference photo, you represent that you either are the person in the photo or have that person's clear permission to upload it for this purpose. You are solely responsible for ensuring you have the necessary rights and permissions to upload any photo of another person. See our Privacy Policy for how reference photos are processed and retained.

5.5 Our Intellectual Property

The Service itself — including our software, interface, branding, and underlying technology (excluding Your Input and Generated Content) — is owned by Comiker and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written consent.

Acceptable Use Policy

Comiker is built to be family- and kid-friendly. You may not use the Service to generate, upload, or distribute content in any of the following categories, regardless of your subscription plan:

Category What this means
Sexual or explicit content No nudity, sexual acts, sexually suggestive depictions of any character, or fetish content, regardless of whether the characters are described as adults
Violence and gore No graphic violence, gore, torture, glorification of weapons used to harm people, or content designed to be disturbing or shocking
Hate and harassment No content that promotes hatred, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
Real people No depictions of real, identifiable individuals (including public figures) without their explicit consent, and never in a sexual, violent, defamatory, or otherwise harmful context
Self-harm and dangerous content No content depicting or encouraging suicide, self-harm, eating disorders, or dangerous activities
Illegal content No content depicting or facilitating illegal acts, including content sexualizing minors in any way — this is subject to immediate termination and reporting to law enforcement
Impersonation and misinformation No content designed to impersonate another person or organization, or to spread deliberately false or misleading information presented as fact

In addition, you agree not to:

  • Attempt to bypass, probe, or circumvent our content moderation or safety systems
  • Use the Service to generate content for resale as a competing AI comic-generation tool, or to train a competing AI model
  • Use automated means (bots, scripts) to access the Service outside of any API we may officially provide
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
  • Misrepresent your identity, impersonate any person or entity, or misuse another user's account
  • Use the Service in any way that violates applicable law

We reserve the right to remove content or restrict accounts even in borderline cases not explicitly listed above, where we reasonably believe the content is inconsistent with Comiker's family-friendly purpose.

Suspension and Termination

7.1 Our Right to Suspend or Terminate

We may suspend or terminate your account and access to the Service immediately, without prior notice and without refund, if we reasonably believe that you have:

  • Violated Section 6 (Acceptable Use Policy) or any other provision of these Terms
  • Provided false information during account registration
  • Engaged in fraudulent, abusive, or illegal activity in connection with the Service
  • Created a risk or possible legal exposure for Comiker, our service providers, or other users

Where content involves potential illegal activity, including content that may sexualize minors, we reserve the right to preserve relevant account and content data and to report such content to the National Center for Missing & Exploited Children (NCMEC) or other appropriate law enforcement authorities, as required or permitted by law.

7.2 Effect of Termination

Upon termination for violation of these Terms, your right to use the Service ends immediately. Outstanding subscription charges remain due, and Section 4.4 (Refunds) governs whether any amount is returned to you — in the case of termination for cause, no refund will be issued.

7.3 Your Right to Terminate

You may stop using the Service and close your account at any time by contacting us at the details in Section 16, or by cancelling your subscription as described in Section 4.3 and discontinuing use of the Service.

Disclaimers

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Any particular generation will produce a result that meets your expectations
  • Any third-party AI provider we rely on will be available at all times or will continue to be used by us indefinitely
  • Generated Content will be free of unintentional similarity to existing copyrighted or trademarked works, given the nature of AI training data

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to that extent.

Limitation of Liability

Some jurisdictions do not allow the limitation or exclusion of liability for certain types of damages, so some of the above limitations may not apply to you to that extent.

Indemnification

You agree to defend, indemnify, and hold harmless Comiker and its officers, employees, and service providers from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Input, including any reference photo you upload and your right to upload it; (b) your use of Generated Content in violation of Section 5 or Section 6; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of a third party.

Third-Party Services

The Service relies on third-party providers, including OpenAI, fal.ai, Amazon Web Services, Lemon Squeezy, Brevo, and Google, as described in our Privacy Policy. We are not responsible for the availability, performance, or practices of these third-party providers, and your use of features dependent on them is also subject to their respective terms. If a third-party provider becomes unavailable, discontinues service, or changes its terms in a way that affects the Service, we may need to modify or temporarily suspend related features, and we will make reasonable efforts to notify affected users.

Modifications to the Service

We may add, modify, or discontinue features of the Service at any time, including art styles, page limits, and credit costs. We will make reasonable efforts to provide notice of material changes that negatively affect existing paid subscribers, but we are not obligated to maintain any specific feature indefinitely.

Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, except to the extent that mandatory consumer protection laws of your country or state of residence apply and cannot be waived.

13.2 Dispute Resolution

Before filing a claim against Comiker, you agree to first contact us at the details in Section 16 and attempt to resolve the dispute informally. If we are unable to resolve the dispute within thirty (30) days, either party may pursue the dispute in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim in your local courts.

13.3 No Class Actions

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, business practices, or legal requirements. If we make material changes, we will provide notice by posting the updated Terms on this page with a new effective date and, where appropriate, by additional notice such as an email to registered users. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

Miscellaneous

  • Entire agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Comiker regarding the Service, superseding any prior agreements.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
  • No waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force majeure: We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including third-party AI provider outages.
